Terms of service

1. About these terms

These terms are an agreement between you and Collatero, a service of Team Ingenious, based in Jeddah, Saudi Arabia (“Collatero”, “we”, “us”). “You” means the organisation using Collatero and the people who use it on its behalf. If you accept these terms for an organisation, you confirm that you’re authorised to do so.

If your organisation has signed a proposal, order form or service agreement with us (your “order”), the order takes priority wherever it differs from these terms.

2. This website

You’re welcome to browse collatero.com and share links to it. The collateral, names, people and companies shown on this website are illustrations, not real customers. Please don’t copy our designs, text or videos for your own use without our permission.

3. The service

Collatero automates your brand collateral. We learn your brand, our design team builds your dashboard and automations, and your team then generates collateral in seconds from any browser or through WhatsApp.

Your order sets out what’s included, such as the collateral, automations, users, volumes and support. When you need a new collateral, ask us and we’ll add it to your dashboard as your order describes. We keep improving Collatero and may change its features, but we won’t materially reduce what you’ve paid for.

4. Your account

You decide who on your team has access. You’re responsible for keeping log-ins safe and for what’s done under your account. Tell us straight away if you think your account has been misused. Only phone numbers registered to your account can send requests to Collatero on WhatsApp.

5. Your content

“Your content” means everything you give us or generate with Collatero: brand material, guidelines, the data you import, your messages and voice notes, and the collateral made from them.

• You own your content. You allow us to use it only to provide, support and secure Collatero for you.
• You confirm that you have the rights to the content you give us, including permission to use any personal data in it (such as names and photos of employees, students, patients or guests) for the collateral you make.
• You’re responsible for the details you enter, such as names, dates and numbers, and for checking collateral before you send or print it.

6. Our work

The Collatero platform, software and automation technology, and the know-how behind them, belong to us. We design the collateral templates and automations for your brand, for your use. While your subscription is active, you can generate collateral from them within your plan. Everything you’ve generated is yours to keep and use, even after your subscription ends.

7. Acceptable use

You agree not to:

• use Collatero to make anything unlawful, misleading or defamatory, or that infringes someone else’s rights;
• use another organisation’s brand without its permission;
• try to access other customers’ data, get around our security or overload the service;
• copy, resell or reverse engineer Collatero.

If you seriously break these rules, we may suspend your access. We’ll tell you why and, where we reasonably can, give you a chance to put things right first.

8. Fees and payment

Collatero is priced for each customer, and your order sets out your fees, billing period and payment terms. Fees don’t include VAT, which we add at the applicable rate. If an invoice is overdue, we’ll remind you. If it’s still unpaid 14 days after that reminder, we may pause the service until it’s settled.

9. Our guarantee

Every collateral set up on your dashboard is generated in under 15 seconds, from the moment you press Generate.

If it isn’t, tell us at hello@collatero.com, letting us know which collateral it was and when it happened. We’ll fix it. If we can’t fix it within 7 days, we’ll refund the fees you paid for the month in which it happened.

The guarantee doesn’t cover:

• time spent uploading, downloading or delivering files over your internet connection or WhatsApp;
• the total time of a large batch: each collateral in a batch is covered, but a batch of many takes longer in total;
• collateral our design team is still setting up or changing for you;
• interruptions caused by events beyond our reasonable control.

10. Availability and support

We work to keep Collatero available around the clock, but we can’t promise it will never be interrupted. We’ll tell you in advance about planned maintenance and try to schedule it outside Saudi working hours. Any service levels or support hours in your order also apply.

11. Confidentiality

We each keep the other’s non-public information confidential and use it only for our work together. This doesn’t apply to information that is already public, or that the law requires to be disclosed.

12. Data protection

Our privacy policy explains how we handle personal data. For personal data in your content, you decide how it’s used and we process it on your instructions, as Saudi Arabia’s Personal Data Protection Law requires.

13. Term and ending

Your subscription runs for the period in your order and renews as the order describes. Either of us may end it as the order sets out. Either of us may also end it straight away if the other seriously breaks these terms and doesn’t put it right within 30 days of being told.

When your subscription ends, you have 30 days to download your generated collateral. After that, we delete your content unless the law requires us to keep it.

14. Liability

We provide Collatero with reasonable skill and care. To the extent the law allows, we make no promises about the service beyond those in these terms and your order.

Neither of us is liable for indirect losses, such as lost profits, revenue or goodwill. Our total liability in any 12-month period is limited to the fees you paid us in that period. Nothing in these terms limits liability that the law doesn’t allow to be limited.

15. Changes to these terms

We may update these terms from time to time and will update the date at the top. We’ll email customers at least 30 days before a significant change takes effect. Changes don’t alter an order you’ve already signed until it renews.

16. Governing law

These terms are governed by the laws of the Kingdom of Saudi Arabia. If a dispute arises, we’ll first try to resolve it by talking. If we can’t, the competent courts in Jeddah will decide it.
